A court has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement is without legal authority.

"Since his return from wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her ruling.

The case stems from a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an mistake. Following his repatriation to the United States to face human smuggling allegations, he was detained in immigration custody.

In her decision, the court noted that the authorities lacks a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
