What Lies Ahead in the Comey and James Trials?

Two prominent opponents of former President Trump secured major legal victories on Monday when a US judge threw out the federal indictments filed against them.

Over recent weeks since their indictments, former FBI Director James Comey and NY AG Letitia James have maintained vehemently that they are not guilty, claiming that the administration and DOJ are simply singling out them for retaliation.

US District Judge Cameron Currie dismissed the charges against them due to prosecutor Lindsey Halligan's invalid assignment as federal prosecutor. However, she left the door open for the federal authorities to try again.

Comey admitted that likelihood after the decision, saying he believes the former president will probably target him once more.

And White House spokeswoman Abigail Jackson seemed to confirm it: This isn't the final word on this issue.

But the DOJ confronts steep hurdles to successfully prosecute both after this defeat, and legal analysts hesitate to forecast what could occur next due to the cases' unprecedented nature.

Could the justice department appeal?

The Department of Justice can contest Judge Currie's ruling before a federal appeals court. In this case, that would be the Fourth Circuit Appeals Court.

Attorney General Pam Bondi signaled she would take this route, vowing to use all available legal action, including an immediate appeal.

In other cases, the former administration has aggressively appealed adverse decisions, taking cases from trial courts and sometimes accelerating its petitions up to the Supreme Court.

Abbe Lowell, James's lawyer, pledged to keep fighting any additional politically driven indictments through every lawful means available.

If there is an appeal, the justice department probably would have its own attorneys present the arguments, making Halligan's involvement in the appeal unclear.

Could there be fresh indictments?

The federal prosecutors charged James Comey with lying to Congress and obstructing justice. Federal prosecutors charged Letitia James with bank fraud and making false statements to a financial institution.

Each entered not guilty pleas. In addition to arguing Halligan's appointment was invalid, both also asserted to be victims of retaliatory legal action.

Since the initial charges were dismissed (although appeals might alter this), the DOJ might try to convene fresh grand juries and obtain new charges.

As far as everything I've seen, a different attorney could bring James' case to a new grand jury and secure a new indictment, said Ms Levine.

But John Day, head of the American College of Trial Lawyers, said it could be a complicated path – certainly in Comey's case.

I can tell you it will be hotly contested, whether Mr Comey's case can be re-indicted if a lawfully appointed prosecutor is assigned and is able to secure an charge.

He described the complex web of lawyers, judges, and motions involved as a legal quagmire with no easy solutions.

It might be more difficult for the DOJ to try to file the exact same charges against Comey.

A key issue is the legal time limit – the time frame that government lawyers had to indict Comey for these specific allegations – which expired at the close of September. Nonetheless, the indictment's dismissal would trigger a six-month grace period for the DOJ to refile the case.

Still in that situation, his lawyers said it intends to argue the government is out of time.

The decision further indicates that because the charge is void, the time limit has expired and there can be no further indictment, lawyer Patrick Fitzgerald said Monday.

What happens to prosecutor Lindsey Halligan?

In the pair of rulings on the indictments against Comey and James, Judge Currie was blunt: Halligan's appointment was improper.

Judge Currie wrote in the James decision that the Attorney General's attempt to install Halligan as Acting US Attorney for the Virginia Eastern District was invalid.

As a result, Halligan had no lawful authority to file the charges, she wrote.

Federal prosecutors are proposed by the US president and need US Senate confirmation. Federal statutes govern how people can be assigned on a temporary basis, but Judge Currie found that Halligan's assignment had breached these laws.

This makes Halligan's role on future cases against James and Comey, once more, unclear.

The decision might also raise doubts on other cases Halligan has brought in the Virginia Eastern District where she serves.

But Attorney General Bondi said on that day that she designated Halligan a special US attorney and praised her work as outstanding.

The administration stood by its stance that Halligan's appointment was legal, press secretary Karoline Leavitt told the press on Monday.
